Terms of use for the Mayrank service
Mirank LLC (hereinafter referred to as the "Company") publishes this Agreement, which determines the procedure for using the site on the Internet at myrank.com (hereinafter referred to as the "Portal"), is a user agreement for any person or company using the portal, materials or other elements of the Portal, hereinafter referred to as the "User". The company offers to conclude an Agreement for any User. The agreement is set forth in a standard and unchanged form for all in the form of a public offer, by generally accepting the following conditions.

 

1. The Subject of the Agreement

1.1. The Agreement on the use of the Portal (hereinafter - the "Agreement") governs the terms of use by the Users of the Portal.

1.2. The current version of the Agreement is available at - (http://myrank.com/legal_info.php). The User undertakes to follow the current version of the Agreement, as well as the version of the Agreement from the moment the Portal or its services start using.

1.3. The agreement can be changed by the Company without any prior notice to the user. The new version of the Agreement comes into force from the moment it is posted, unless otherwise provided by the new version of the Agreement.

1.4. The Agreement comes into force from the moment you start using the Portal or its services. 

1.5. The Portal may additionally establish the terms of use of its individual services and sections with information.

1.6. If the User does not accept the Agreement, he cannot use the Portal, its materials and services.

1.7. All materials, resources and services posted on the Portal at the time of approval of the Agreement, as well as those that will be posted in the future, are the subject of the Agreement and the property (used asset / object) of the Company, unless otherwise indicated on the Portal.

1.8. The Company and / or the editorial office of the Portal appointed by the Company (hereinafter referred to as the “Edition”) have the right to add, change, delete, supplement the materials and structure of the Portal.

1.9. The Company and / or the edition of the Portal appointed by the Company (hereinafter referred to as the “Editorial Office”) have the right to close the Portal or any section or service at any time without prior notice to the user.

1.10. The User is obliged to comply with the rules for the use of materials and other elements and services of the Portal posted on the main page of the Portal.

1.11. In case of revealing the facts of unauthorized use of the materials of the Portal, the User must inform the editorial office of this as soon as possible.

1.12. The Company informs that through the Portal it is possible to gain access to other resources (sites) on the Internet. The company has no control over these sites, and the User gains access to them solely at his own risk. The user acknowledges and agrees that the company is not responsible for the availability of such resources (sites) and their content, as well as for any consequences associated with the use of the content of these sites.

1.13. The User uses the Portal solely at his own risk. The user is responsible for any damage caused to the user's computer and its data. The Company is not responsible, including for the compliance of the Portal with the goals of the user.

1.14. The Company and / or the Editorial Office is in no way liable for any direct or indirect losses, as well as losses incurred in connection with the payment of penalties, or any losses in general, even if the Company was warned in advance of the possibility of such damage in connection with the use of and / or inability to use the Portal.

1.15. The Company tries to ensure the smooth operation of the Portal, but is not responsible for the complete or partial loss of the Portal content, as well as for the insufficient quality or speed of viewing such content.

1.16. The content of the Portal cannot be used by third parties for public viewing.

1.17. The content of the Portal cannot be used by third parties for commercial purposes.

1.18. This Agreement is an accession agreement, in connection with which:
- The Agreement is concluded only by joining it as a whole by the user who has expressed his intention to conclude the Agreement;
- The user who has expressed his intention to conclude the Agreement cannot offer his terms of the Agreement;
- In case of disagreement with the content and form of the Agreement or its individual provisions, the User who expresses his intention to conclude the Agreement has the right to refuse to conclude it.

1.19. The user agrees that he has entered into the Agreement with full understanding of its content.

1.20. Confirmation of the conclusion of the Agreement is the use of the Portal or its services.

1.21. All requests for the fair use of content (materials) must be sent by email to (info@myrank.com)

2. The company has the right:

2.1. Use the email addresses of registered users to send messages;

2.2. Delete messages and user comments if they contradict the terms of the Agreement and the norms of the current legislation of Ukraine;

2.3. Block the account (account) of the User on the Portal in case of violation of the terms of the Agreement;

2.4. Delete any content without giving reasons, in case of violations of the current legislation of Ukraine, the terms of the Agreement and / or other rules for using the Portal;

2.5. At any time, close any resource (service) of the Portal both with and without prior notice to the user. In this case, the Company is not responsible for the termination of access to its resources on the Portal.

3. The user has the right:

3.1. Create your own text messages, comments, and exchange views on the relevant topics of the published information.
The Company provides the User with the opportunity to participate in discussions on the Portal, including comments, recommendations, viewpoints of readers, reviews, ratings and other services of the Portal.

3.2. Any information that you provide, specifying your name, Identification data on any social network on the Internet, or any image or photograph, becomes public, and can be used by the Company for advertising or commercial purposes in any media, Internet sites or other sources of information.
The user who takes part in the discussion on the Portal (its sections, elements and services) agrees that any personal information provided by the User can be read, collected or used by other users of these services or the Company, and can be used to send unsolicited messages. The company is not responsible for the personal information that the User provides in the comments and is not obliged to publish, delete or edit any of the user's comments.

3.3. The User grants the Administration permission to process the information provided by him, which also provides for the use of such information, including for the purpose of marketing research and targeting on the Portal. The user who participates in the discussion on the Portal (its sections, elements and services) agrees that his actions will be public. They can also be incorporated into RSS feeds, APIs, and made available to other websites using other formats.

3.4. As a result, the information provided by the User may appear on other sites, blogs, and so on. The Company is not responsible for any personal information that you decide to disclose through the functionality of the Portal, and the User agrees that this information will be considered provided by the User, and not by the company.
Information about the User's visit (use) of the Portal (its sections, elements and services) - when accessing the Portal through a browser, application or other client, is automatically recorded on the company's servers. These server logs may contain web requests, IP address, browser type and language, date and time of the request, and also contain one or more cookies that can be used to identify the browser or user account or person (in cases established by law).

3.5. User messages - when the User, in the process of interacting when using the Portal, sends a message, including to the support service, it is possible to store and process these messages to answer questions and further improve the functioning of the Portal and the company's services. To communicate with the User of the Portal, the e-mail address provided by the User can be used.

3.6. By accepting this Agreement, the User understands and agrees that he transfers to the Company non-exclusive intellectual property rights to those objects of intellectual property rights that are posted by him on the Portal. The right to use works, articles, comments, photos, videos, graphics, other objects of intellectual property rights (hereinafter for convenience - "work") and the non-exclusive right to authorize or prohibit the use of a work by others gives the Company the right to independently use and / or permit or prohibit:

3.6.1. Reproduction of works;
3.6.2. Public performance and public communication of works;
3.6.3. Public display and public display;
3.6.4. Any re-promulgation of works if carried out by an organization other than the one that made the first promulgation;
3.6.5. Translations of works;
3.6.6. Revisions, adaptations and other similar changes to works;
3.6.7. Inclusion of works as constituent parts in collections, anthologies, encyclopedias, etc .;
3.6.8. Distribution of works by the first sale, alienation in another way or by leasing or renting and by other transfer prior to the first sale of copies of the work;
3.6.9. Bringing their works to the public in such a way that its representatives can access the works from any place and at any time at their own choice;
3.6.10. Property lease and / or commercial rental after the first sale, alienation in another way of the original or copies of works, including in a form that can be read by a computer;
3.6.11. Import of copies of works.

4. Materials provided by the User:

It is forbidden to post and distribute on the site:
4.1. Calls for violent change or overthrow of the constitutional order or the seizure of state power;

4.2. Calls for the division of the borders, territory or state border of Ukraine, violation of the order established by the Constitution of Ukraine;

4.3. Calls for arson, destruction of property, seizure of buildings and structures, forcible eviction of citizens;

4.4. Calls for aggression or incitement to military conflict or post other material that may constitute a criminal offense or a reason for its commission;

4.5. Content that is illegal, harmful; - insult morality, honor and dignity, rights and legally protected interests of third parties, as well as obscene expressions and materials and expressions of a pornographic, erotic or sexual nature;

4.6. Advertising, commercial or adaptation materials, the placement of which is not agreed with the Company;

4.7. Intellectual property objects, which are copyrighted, without the appropriate permission for such public placement or distribution;

4.8. Materials containing computer codes intended to disrupt, destroy or limit the functionality of any computer or telecommunications equipment or programs, to carry out unauthorized access, as well as serial numbers to commercial software products, logins, passwords and other means for obtaining unauthorized access to paid resources in the Internet;

4.9. Personal data of other users;

4.10. Materials, the content and / or distribution of which violates the current legislation of Ukraine and the provisions of international legislation;

4.11. Commercial information that relates to the identity of the user. The user confirms that he is responsible for compliance with the requirements of the legislation of Ukraine, including the Constitution of Ukraine, the laws of Ukraine "On the protection of public morality", "On advertising", "On copyright and related rights", "On the protection of marks for goods and services ", but not limited to the above, including full responsibility for the content and form of any information provided and posted on the Portal. In the event of claims from third parties against the Company in connection with the information posted by the User on the Portal (including claims from the owners of copyright and / or related rights, their authorized representatives or third parties), the User is obliged to independently and at his own expense settle and resolve all disputes with persons who have claims, as well as reimburse the Company for losses incurred in full.

5. Moderation

5.1. Moderation of interactive resources on the Portal (comments, forums, blogs) is carried out according to the principle of post-moderation. These posts are first added and then reviewed by moderators.

5.2. If the moderator believes that any text violates the rules for using the Portal or the Agreement, he has the right to delete it.

5.3. If the user has witnessed that someone's rights or current laws are being violated on the site, he must immediately inform the site administration about this.
